The Portal numscout.com is a service of numscouters gmbh, Neuhofstrasse 45, 8315 Lindau (in the following the “operator”).

The following GTCs regulate the rules for the use of the portal numscout.com.

The GTCs are also applicable when the portal is being used outside of Switzerland. Your contact partner is numscouters gmbh.

As the operator of the numscout.com website, numscouters gmbh provides registered members with access to a database.

Anyone interested has the opportunity to register free of charge. After registration, the member completes his profile with the optional or, if applicable, the mandatory information.

Members also have the option to register for a paid membership. A personal consultation or support by employees of the operator in matters relating to numscout is not part of the services and can, if necessary, be requested from the operator via the contact form. A personal consultation is subject to a fee.

The members are before the access to chargeable areas on the cost obligation, the scope of services and the payment modalities expressly pointed out. After payment has been made, they can access these areas and use the extended functionalities.

Part of the service (and therefore part of the contract) is also the following:
Limited storage space – storage of your calculations and profile data.

During your membership: data on the website is stored for 12 months and then automatically deleted on an ongoing basis, even if you remain a member.

Upon unsubscription or inactivity: If a member closes their account by unsubscribing, their profile data will be deleted 30 days after unsubscribing.

After entering the personal data and the selected membership, the member is taken to the payment page of our Swiss payment provider (PayRexx AG) and can select a payment method there. After successful completion of the payment, the member receives an e-mail from PayRexx and numscout.ch with the confirmation of their membership including an invoice.

The contract for a paid membership between the operator and the member comes into effect by the activation of the paid area. The operator grants full access to the services only after receipt of the payment.

With the activation of the paid area by the operator the term of the paid membership begins as well.

The use of the Services within the scope of Art. 2 Para. 2 of these GTCs is free of charge.

A more extensive use of the Services is possible through the conclusion of a paid membership. The prices and payment methods of the paid services can be viewed in the membership area of the numscout.ch website. They will be indicated at the latest when the member wishes to access chargeable services.

All prices are final prices and therefore already include the statutory value added tax.

Payment of the fees shall be made to the operator in advance, without any deduction, for the period selected.

The member has various payment options at their disposal. They are listed in the membership area on the website.

The operator's privacy policy and cookie policy apply.

You can reach our customer service from Monday to Friday between 9 am and 6 pm. Your requests can be processed especially quickly if you are already a member and provide your email address.

The term of the paid membership at numscouit.com (Art. 2 Para. 3 of these GTC) is at least seven days, optionally also one, six or twelve months.

The paid membership at numscout.com ends automatically after the duration of the originally selected initial term (for example, after one month, if a one-month membership was initially selected).

For the purpose of calculating the contract period, months shall not be deemed to be calendar months, but the period from a calendar-determined day of a month to the same day of the following month (i.e., for example, from May 15 to June 15 of the same year).

Every member can unsubscribe from numscout.com at any time and thus close their account. This can be done via the section „My account“, by e-mail or via the contact form. Deregistration from the service is viewed at the same time as a regular cancellation of the paid membership. Deregistration means that the member's profile on numscout.com is immediately no longer accessible. For further consequences, see article 2 (6). The member will be informed by e-mail about the successful closure of their account.

After expiry of the paid membership, the status of the member automatically changes back to free membership and the associated restrictions.

The free membership according to Art. 2 (2) of these GTC can be terminated at any time. This can also happen, for example, by the member logging out of numscout.com and thus closing their account (see Art. 8 (4). For the consequences, please also read Art. 2 (6).

The paid membership with numscout.com ends automatically after the duration of the originally chosen initial term (for example, after one month, if a one-month membership was initially chosen).

numscout.com has the right to deactivate a customer's user account at any time without stating reasons and to close it without any consequences of compensation within 14 days after closing.

In the event of use of the offered services by the customer that is contrary to the contract, illegal or immoral, or in the event that the customer has given cause for complaints, numscouters gmbh may immediately withdraw from the agreement without any consequences of compensation and discontinue the provision of services without prior notification to the customer and without any consequences of compensation, and/or deactivate the customer's user account; in both cases, a price already paid in advance for a certain term shall be forfeited and the customer shall not be entitled to any claim for damages. All claims of numscouters gmbh remain reserved.

numscout.com contains information and content from numscouters gmbh. We strive to ensure the accuracy of this information and content, but expressly disclaim any warranties or representations in this regard. numscouters gmbh also disclaims any liability for damages that may arise from the retrieval, access, use or application of this information and content. The retrieval and use of such information and content is solely at the risk of the customer.

If numscouters gmbh, despite all due care, cannot fulfill its contractual obligations due to force majeure, such as natural events, armed conflicts, strikes, unforeseen official restrictions and technical disruptions, which can be attributed to the area of responsibility of third parties, the customer shall have no claim to fulfillment of the contract for the duration of the event.

numscout.com is not liable for misuse of the Internet and associated damage to the customer by third parties, for security defects and disruptions to the telecommunications networks of third parties and the Internet, or for operational disruptions and disruptions to third-party offers.

The language available for the conclusion of the contract is English.

The contract text is not stored by the operator and is therefore not accessible to the member after the conclusion of the contract by the operator. These terms and conditions can be saved at any time or printed out using the print function of your browser.

The operator is entitled to amend these GTCs, as far as essential provisions of the contractual relationship remain unaffected, the amendment is necessary to adapt to developments that were not foreseeable at the time of the conclusion of the contract and the non-observance of which would significantly disturb the balance of the contractual relationship. Material provisions in this sense are in particular those concerning the type and scope of the contractually agreed subject matter of performance and the term, including the provisions on termination.

The operator is entitled to change the subject matter of the service, provided that this is necessary for a valid reason, the member is not objectively worse off compared to the subject matter of the service (e.g. maintenance or improvement of access options) and the subject matter of the service is not significantly deviated from. A good reason for changing the subject matter of the service in this sense exists if the subject matter of the service is adapted to technical developments, if third parties from whom the operator obtains the necessary preliminary services for the provision of its services change their range of services, or if legal provisions or court decisions make it necessary to restrict or expand the subject matter of the service. The operator is entitled to limit the scope of content to be posted by a member by changing the subject matter of the service.

The operator is entitled to increase the agreed remuneration if this is done in order to pass on increased costs to the member. The right to adjust the price includes in particular the case that third parties from whom the operator obtains necessary preliminary services to provide the services owed under this contract, increase their prices. Furthermore, the Operator shall be entitled to adjust the prices accordingly in the event of an increase in value added tax.

Intended changes to the GTCs, the subject matter of the service and the subscription agreement shall be communicated to the Member by e-mail to the e-mail address provided by the Member at least one month before they take effect. The member shall have a special right of termination at the time the changes take effect. If the member does not give written notice of termination within one month of receipt of the notification of change, the changes shall become part of the contract at the time they take effect. The member will be specifically informed of this consequence in the notification of change.

There are no side agreements. In the event of invalidity or partial invalidity of one of the provisions of these Terms and Conditions, the validity of the remaining provisions shall remain unaffected.

We are obliged to refer you to the European Online Dispute Resolution platform (OS platform) of the European Commission, which you can reach at http://ec.europa.eu/odr. We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
